Visas for the USA

The firm offers a full range of US visa and immigration services, from temporary visas to permanent residency and citizenship. Thomas Thorup has more than fifteen years of experience with US visas, having obtained thousands of them for Danish and international clients — from developing visa strategies for large multinational corporations to helping married couples through the green card process.

E Treaty Investor or Trader Visa. This visa is for Danish companies or individuals who have substantially invested in, or trade with, the United States, and who want to send Danish employees to take on a managerial, executive, or essential/specialist role there. It is well suited to entrepreneurs starting a US business or expanding into the US market.

L-1 Intracompany Transferee Visa. The L-1 enables a Danish company to send an executive, manager, or specialized-knowledge employee to its US office. If the company does not yet have a US office, the L-1 may still be usable to send someone to establish one. It works for both small and large organizations.

Blanket L Petitions for Organizations. Larger organizations with an established structure in both Denmark and the US can use blanket L petitions to send intracompany transfers more quickly, efficiently, and cheaply. Employees of an approved organization can bypass standard immigration queues and proceed directly to the embassy.

H-1B Specialty Occupation Positions. The H-1B is for employees with a degree, or the equivalent, in a specific field, employed in a qualifying position. The process involves a lottery selection followed by a Department of Labor certification process.

B-1 Temporary Business Visa. The B-1 allows business activities in the US for up to six months, including consulting with business associates, attending conferences, negotiating contracts, short-term training, or preparing an investment. It is also useful for those with ESTA issues, such as prior travel to restricted countries or prior visa denials.

O-1 Extraordinary Ability Visa. The O-1 is for individuals with extraordinary ability in business, arts, sciences, or related fields, allowing them to work and live in the US for up to three years at a time, renewable thereafter. It requires evidence of significant achievements and a US work offer in the relevant specialty. Rosenfalck & Thorup has obtained O-1 visas for professionals ranging from musicians to football coaches.

J-1 Visa (Exchange Visitor / Graduate Visa). The J-1 lets recent graduates gain US experience. Foreign nationals can come to the US to demonstrate special skills or receive on-the-job training for periods ranging from a few weeks to several years — useful for companies with graduate programs or internal international training programs.

Business-Based Immigration (Green Cards). Extraordinary individuals, multinational managers, and current international employees may obtain US permanent residence based on employment or achievement. Rosenfalck & Thorup reviews work experience, education, pay level, and skills to assess eligibility, and can manage the entire process.

Family-Based Immigration (Green Cards). The firm helps clients navigate bringing or sponsoring a spouse, parents, and/or children to the US, including fiancé visas, green card renewals, marriage-based green card applications, and applications for children or parents of US citizens.

Emergency and Expedited Matters, US Embassy Issues, and Appeals. Rosenfalck & Thorup assists in emergencies or cases with very tight timelines, including situations where normal processing times can otherwise be avoided. The firm also reviews unfavourable immigration or embassy decisions to advise on what can be done and whether the decision can be resolved.
